These Terms of Service ("Terms") govern your use of artnovel.studio (the "Website") and purchases from Art Novel Studio ("we," "us," or "our"). By creating an account, placing an order, or otherwise affirmatively accepting these Terms, you agree to them together with our Privacy Policy, Shipping Policy, Refund and Return Policy, and applicable product-page terms. If you do not agree, do not use the Website or place an order.

Seller Information

Our Store and Service Providers

The Website operates through Shopify. Physical products are manufactured and fulfilled through Printify and production facilities in its network; payments and deliveries may be handled by independent providers and carriers. Your purchase agreement is with Art Novel Studio, not those providers. We remain responsible for our obligations to you under these Terms and applicable law.

Eligibility and Acceptable Use

You must have legal capacity to enter a contract and provide accurate information. A parent or legal guardian must place an order for a minor who cannot contract independently. You may not use the Website to violate law, commit fraud, submit false orders, distribute malware, gain unauthorized access, scrape content at scale, infringe rights, impersonate others, abuse refunds or promotions, or disrupt the Website.

Products and Appearance

We sell canvas artwork, other printed art products, commissioned or personalized artwork, Digital Downloads, and related services. Product pages identify available sizes, orientation, format, quantity, and variations. Interior mockups are illustrative and may not show exact scale; furniture, lighting, frames, and decorations are excluded unless expressly stated.

Because physical products are individually manufactured, minor differences in color, brightness, image placement, canvas tension, or edge cropping may occur. Screen settings, printing processes, materials, and lighting can also affect appearance. This does not excuse significant printing errors, damage, incorrect sizing, or a product materially different from its description or an approved custom design.

Custom and Personalized Orders

You confirm that you have the right to provide and use all photographs, references, text, names, and other materials submitted for a custom order. We may refuse unlawful, infringing, abusive, or technically unsuitable requests.

Every custom artwork order includes a digital preview for review before printing. Physical production begins only after your final approval. You must check composition, spelling, names, dates, colors, placement, size, and other personalized details. Written approval authorizes production, but does not waive claims involving damage, manufacturing defects, or material deviation from the approved design. Changes requested after approval may require additional payment and may delay production.

Before final approval, you may request up to five individual changes to the custom artwork. An individual change may adjust colors, details, placement, atmosphere, or another element within the original concept and the information provided with the order. It may not completely replace the original idea, subject, or concept. A substantially new concept, replacement of the original subject, or complete recreation based on new information is not an included change and may require additional payment or a new order. We may also suggest adjustments or creative options; any such suggestions will be discussed with you before they are applied.

Once the artwork has been finally approved and sent to production, further changes are no longer possible.

Each custom artwork is created individually for the customer and will not later be offered for sale to other customers.

Orders, Prices, and Payment

Adding an item to the cart does not reserve it. An order is received after checkout is completed, payment is authorized or received, required information is provided, and confirmation is sent. Prices are shown in the currency displayed on the Website. We may change future prices, but not a paid and accepted order except to correct an obvious error with your agreement or provide a refund.

Payments may be processed through Shopify Payments, PayPal, or another provider. You confirm that you are authorized to use the payment method. Your bank or payment provider may charge currency-conversion or international-transaction fees.

Taxes, Customs, and Promotions

Taxes may be included or calculated at checkout. Unless checkout clearly states otherwise, recipients are responsible for customs duties, import taxes, VAT, brokerage, handling, or local carrier fees on international physical orders. Digital Downloads are not physically imported.

Promotional codes may be limited by time, product, destination, minimum order, transferability, or combination with other offers. Refunds reflect the amount actually paid. Advertised gifts are subject to availability and may ship separately. If a material promotional gift becomes unavailable after purchase, we may provide a reasonably comparable substitute or another remedy required by law.

Order Refusal and Cancellation

Before shipment or digital delivery, we may refuse or cancel an order because of unavailability, delivery impossibility, an obvious pricing error, failed payment verification, suspected fraud, incomplete information, illegality, or violation of these Terms. We will refund the unfulfilled portion of a paid order, except for non-refundable custom work already completed with your prior agreement or as otherwise permitted by law. We may request additional verification before cancellation.

Production, Shipping, and Delivery

Made-to-order production may begin shortly after confirmation. Most physical orders are produced and shipped within 2–7 business days after we receive a complete order. For this commitment, "ship" means placing the product in the carrier’s possession. Carrier transit and total delivery times are estimates governed by our Shipping Policy.

If we cannot ship within the stated period, we will provide the notice and options required by applicable law, including the option to consent to a revised shipping date or cancel the unshipped order for a full and prompt refund, consistent with the FTC Mail, Internet, or Telephone Order Merchandise Rule (16 C.F.R. Part 435). Products may arrive in separate packages without an additional shipping charge.

Risk of Loss

Subject to our Refund and Return Policy and applicable law, risk of accidental loss or damage passes to you when a physical product is delivered to the shipping address provided with the order. This does not limit claims involving products lost or damaged in transit, incorrectly delivered, or marked as delivered but not reasonably locatable.

Returns, Refunds, and Product Problems

Cancellations, returns, replacements, and refunds are governed by our Refund and Return Policy. Inspect physical products promptly and report damage, defects, or incorrect products within the stated claim period; we may reasonably request photographs or other evidence. Approval of a custom design does not eliminate rights relating to manufacturing defects. Mandatory consumer rights remain unaffected.

Digital Downloads

Digital Downloads are delivered manually, not instantly. A high-resolution file or functioning download link is normally sent to the checkout email within 24–48 hours after payment confirmation. If delayed, we will provide a revised estimate. Before delivery, you may cancel for a full refund except for personalized digital work begun with your prior agreement where law permits.

A Digital Download is considered delivered when a usable file or functioning link is sent to the email address provided. After delivery, the purchase is final and non-refundable except where required by law, where we cannot deliver a usable file, or where the file materially differs from its description.

For consumers who have a statutory withdrawal right, early digital delivery will begin only after any express consent and acknowledgment required by applicable law, including acknowledgment that the withdrawal right may be lost once delivery begins.

Digital License

Upon delivery and subject to payment, we grant you a limited, non-exclusive, non-transferable license to print and personally display the file for personal or household use. Copyright and ownership of the underlying artwork are not transferred.

• You may not resell, sublicense, redistribute, publicly share, or commercially exploit the file.
• You may not upload it to a print-on-demand, stock-art, NFT, file-sharing, or similar platform.
• You may not claim authorship or use it to train a machine-learning or generative-AI model.
• Commercial, promotional, resale, branding, or merchandising use requires a separate written license.

Intellectual Property

To the extent protected by applicable law, Website content and artwork are owned by Art Novel Studio, its artists, or its licensors, or are otherwise lawfully used by us. Purchasing a physical product or Digital Download does not transfer copyright. These Terms do not claim exclusive rights in material that is not legally eligible for intellectual-property protection.

Without permission, you may not reproduce artwork for resale, distribute digital copies, place it on commercial goods, upload it to print-on-demand services, register it as a trademark, or use it to train machine-learning or generative-AI models, except where applicable law does not permit such a contractual restriction. Commissioned or customized artwork remains subject to the same rule unless a separate written agreement transfers or licenses additional rights.

Customer Materials and Privacy

You retain your rights in submitted materials and grant us a limited right to use and share them only as necessary to evaluate and complete the order, work with production and service providers, manufacture and deliver products, provide support, resolve claims, and comply with law. We will not use customer photographs or personalized artwork in advertising, social media, or a public portfolio without separate permission. Personal information is handled under our Privacy Policy.

Reviews and Feedback

Reviews must reflect genuine experience and may not contain unlawful threats, knowingly false statements, spam, advertising, infringing material, discriminatory abuse, or third-party private information. Nothing in these Terms restricts or penalizes an honest review or assessment of our products, services, or conduct. We may moderate content only for legitimate reasons permitted by law.

Website Information, Links, and Availability

We make reasonable efforts to keep Website information accurate, but errors may occur. If a material error affects a paid order, we will offer confirmation of the corrected order or a refund. Independent third-party websites and services are governed by their own terms and practices. We do not guarantee uninterrupted or error-free Website access and may suspend access for maintenance, security, platform failures, or other operational reasons.

Accessibility

We are committed to improving Website accessibility and endeavor to follow generally recognized accessibility practices. We will make reasonable efforts to provide the information or an accessible alternative method.

Liability and Consumer Rights

To the maximum extent permitted by law, Art Novel Studio is not liable for indirect, incidental, special, or unforeseeable losses. Our aggregate liability arising from a particular order will not exceed the amount paid for that order. These limits do not exclude liability that cannot legally be excluded, including fraud, intentional misconduct, applicable personal-injury claims, breach of non-waivable obligations, or mandatory consumer rights.

Users are responsible, to the extent permitted by law, for losses directly caused by their fraud, unlawful use, infringement of third-party rights, submission of unauthorized materials, or material breach of these Terms.

Events Beyond Our Control

We are not responsible for delay or failure caused by events beyond our reasonable control, including natural disasters, armed conflict, transport disruption, strikes, epidemics, fire, government action, utility or internet failure, customs restrictions, production-facility closure, cyberattack, or major provider failure. This section does not eliminate any cancellation, refund, delay-notification, or consumer right that cannot legally be waived.

General Terms

If a provision is invalid or unenforceable, the remaining provisions continue in effect. Delay in enforcement is not a waiver. These Terms, the policies incorporated above, product-page information, and any written custom-order terms form the agreement; specific written custom-order terms control for that order.

Governing Law and Disputes

These Terms are governed by the laws of [STATE], United States, without regard to conflict-of-laws rules. Subject to mandatory consumer law, disputes will be brought in the state or federal courts located in [COUNTY/CITY, STATE]. This provision does not deprive a consumer of non-waivable protections or a forum that applicable law requires in the consumer’s state or country of residence.

Changes to These Terms

We may update these Terms for future Website use and new orders to reflect changes in law, products, operations, or providers. We will post the revised Terms and updated date. Changes do not retroactively alter an accepted order unless you agree or applicable law requires it.
